Estate Planning Michigan Family Dispute

Brian Dailey: Katie, welcome to The Law Show.

Katie: Hi.

Brian Dailey: What can we do for you Katie?

Katie: I was wondering, I went to a hospital for an injury on my foot over 7 years ago now and I received a bill from a collection agency in the mail stating I owed over $700 for this hospital visit. And when I called the hospital and I called the collection agency now that has dissolved, they said that it was billed on the workman’s comp and the business is now closed so there’s no way for them to, I guess, get in touch with owners or I’m not exactly sure how workman’s comp works but I told them that was not a workman’s comp claim. I had covered

Brian Dailey: Katie? Katie?

Katie: Yes.

Brian Dailey: Let me stop you just for a second, okay?

Katie: Okay.

Brian Dailey: How much is the bill?

Katie: Oh, close to $800.

Brian Dailey: All right. And it’s over 7 years old?

Katie: Yeah.

Brian Dailey: All right.

Katie: And it made a big hit on my credit

Brian Dailey: Yeah. Well, guess what? I got a guy who’s going to make another big hit right now, his name is Justin Grove and he’s going to cabrera that right out of the park. So, Justin, how are you going to handle this for Katie?

Justin Grove: Yeah. Katie, they can’t try to–they can’t sue you on this debt because it’s over 6 years old but they still are free to try to collect it from you, so what we do is we challenge them in court to say that this is a debt that they can still go after you for and they won’t be able to prove it so this would be something we could get rid of for you.

Brian Dailey: Isn’t this actually against the Fair Debt Collection Practices Act that they can be responsible for attorney’s fees? Katie, you ought to make an appointment on Monday to come and see Justin Grove for an initial free consultation and we will–he will tell you what you can do and what you can expect. We don’t charge on initial consultation and we can help you out through this, okay?

Katie: Okay.

Brian Dailey: All right. Well, I appreciate it.

Katie: Is it just G-R-O-V-E?

Brian Dailey: Yes. It’s G-R-O-V-E E-X-P-E-R-T. Grove Expert.

Katie: Okay.

Brian Dailey: Unfortunately, all good things must come to an end and The Law Show is no exception.
