Estate Planning Michigan Family Dispute

Brian Dailey: John, welcome to The Law Show.

John: Hi, how are you doing?

Brian Dailey: Fine, thank you. What can we do for you?

John: The question I have is I filled bankruptcy over 7 years ago and it’s cleared, but I’m thinking about filing again. I had a voluntary repossession and now they’re bugging me for over $16,000, so I want to get that cleared up.

Brian Dailey: What do you say, Justin?

Justin Grove: You know, John, you can file Chapter 7 Bankruptcy every eight years so we’d have to look and see when your exact date of discharge was to see if you’d be eligible to file again.

John: Yeah. Well, my date of discharge was like April 8, 2005.

Justin Grove: Oh, 2005. No, you won’t be able to file. It’s every 8 years. You have to wait 8 years.

John: Every 8?

Justin Grove: Yup.

John: Oh, okay.

Justin Grove: Okay?
